What Is OMVIC?
The Ontario Motor Vehicle Industry Council (OMVIC) is the regulator for motor vehicle dealers and salespeople in Ontario. If you sell cars in Ontario, you must be registered with OMVIC and comply with their regulations.
Key Compliance Requirements
All-In Pricing
Ontario law requires that all advertised vehicle prices include all fees and charges the buyer must pay. The only exclusions are HST and licensing. This applies to:
- Your website
- Marketplace listings (AutoTrader, Kijiji, FBMP)
- Window stickers
- Any other advertising
Required Disclosures
Dealers must disclose certain information about every vehicle sold:
- Previous daily rental use — if the vehicle was previously a rental
- Salvage or rebuilt title — if the vehicle has been declared a total loss
- Frame damage — any structural damage history
- Flood damage — if the vehicle has water damage
- Odometer discrepancy — if the mileage may be inaccurate
Bill of Sale Requirements
Every sale requires a detailed bill of sale that includes:
- Full buyer and seller information
- Complete vehicle description including VIN
- All-in price breakdown
- All applicable disclosures
- Warranty information (if any)
- Cooling-off period terms
